A U.S. District Court judge has declared a mistrial in a federal case surrounding the fatal Tempe police shooting of 19-year-old Dalvin Hollins in 2016 after the jury remained deadlocked on all but two claims on Wednesday. An attorney representing Sarah Coleman, Hollins’ mother, filed a civil suit in 2017 alleging wrongful death, excessive force and other violations in her son’s death. The mistrial only applies to the claims for which the jury could not reach a decision. Tempe police responded to reports of a robbery with a suspect who was possibly armed at a Walgreens near McClintock and Guadalupe roads on July 27, 2016. Officers saw Hollins, who fit the description of the suspect, walking nearby and attempted to contact him. Hollins fled and two officers, including Lt. Edward Ouimette, pursued him. Ouimette told Hollins he would shoot him if he didn’t stop running, according to his police report. Ouimette wrote in his report that he saw Hollins reach for a “black semi-automatic handgun.” He fired one round, striking the teenager in the back. Hollins retreated into a maintenance shed at a senior living facility, where he died from his injuries. Neither officer activated their body-worn cameras until after the shooting. Court records obtained by The Arizona Republic said the jury resumed deliberations at 9 a.m. Wednesday, the eighth day of the trial. The jury recessed and reconvened several times before reaching a unanimous verdict on two claims shortly before 2 p.m. The jury decided in favor of Ouimette on Fourteenth Amendment familial association claims by Coleman and Hollins’ father, Calvin Hollins. In order to have won their claims, the City of Tempe said the pair must have proved Hollins was killed by Ouimette’s use of unconstitutional excessive force and that he “acted with a purpose to harm Dalvin Collins unrelated to legitimate law enforcement objectives.” The jury decided in Coleman’s and Hollins’ favor on their battery claim against Ouimette but remained deadlocked on the remaining claims. The judge declared a mistrial on those claims and the jury was excused, according to court records. The trial for claims of wrongful death on the basis of the City of Tempe being negligent in its training or supervision and excessive force on Ouimette’s part was scheduled for Feb. 28. Darien Barret, Hollin’s friend and police brutality activist, spoke to The Arizona Republic and shared that the mistrial has taken an emotional toll on him and Hollin’s family. “I’m upset about it because we’re all waiting on an answer,” said Barret. “Me, family, friends; people who have taken to the streets in order to get justice for my friend.” The City of Tempe released a statement on Wednesday evening that called Hollins’ death a “tragedy” but added that it believes the actions of Ouimette and the Tempe Police Department were “within city and police policies and state and federal law.” The statement noted that the Maricopa County Attorney’s Office did not charge Ouimette in the case. The Attorney’s Office announced its decision in April 2017, saying Ouimette had reason to believe his life was in danger. “The City of Tempe continues to support the dedicated men and women who serve in the Tempe Police Department and acknowledges the difficult jobs they do every day to protect our community,” the statement said. It went on to detail the City’s policing policy reforms and initiatives in recent years, which include its Community Safety Strategic Plan that it said was meant to “plan the future of trusted policing and innovative response in the City of Tempe.” Barret said he believes the lack of transparency from the officers is delaying a final decision and he added that he would like to have a different jury in the upcoming trial. “I’m tired of waiting,” he said. “I really hope this is the last time that we have to go to trial.” Attorneys for Coleman and the City of Tempe did not respond to The Republic’s requests for further comment. Bonnie Lopez describes her younger sister, Melody Morgan, as a creative person who loved drawing and painting. She enjoyed baking and cooking, too, and above all, liked spending time with her sister and mom, Colleen Lackey. At the same time, Lopez said Morgan dealt with physical and mental health issues, including seizures, migraines, bipolar disorder, multiple personality disorder and schizophrenia. After a fall on her head at 10 left her with a brain cyst, she was adjudicated as disabled and received Social Security disability benefits. Over the years, she had three psychiatric hospitalizations following attempts to die by suicide. “She battled a lot of hidden demons,” Lopez said. Morgan’s family says Nevada prison officials failed to take appropriate precautions and provide proper care while she was incarcerated, leading to her death by suicide at age 25 in 2018. Lopez and Lackey filed a wrongful death lawsuit in 2020, seeking more than $75,000 from the Department of Corrections and a number of its officers. They claimed that Morgan did not receive a medical evaluation and was not put on suicide watch, actions family members say could have saved her life. “Lackey and Lopez were deprived of their daughter and sister’s care, comfort, love, protection, advice, society, and physical assistance,” the lawsuit reads. In June, the case was moved to a federal court because several of the charges involved federal civil rights law. And earlier this month, the state Board of Examiners approved a request by the state attorney general’s office for $40,000 to pay for outside legal assistance to represent its defendants. The corrections department officers implicated in the lawsuit are split in their defense, represented by different attorneys and blaming one another for the miscommunication issues that led to Morgan’s death. Morgan’s case isn’t unique. Dozens of Nevada inmates die by suicide every year at a rate of about 28 per every 10,000 prisoners, 20 times 2019’s national suicide rate of 14 per 100,000 individuals. And studies show that incarcerated women tend to attempt suicide at higher rates than their male counterparts. From 2001 to 2014, suicides accounted for 7 percent of the deaths that occured in Nevada Department of Corrections facilities. It was the most common non-natural cause of death according to the UNLV Center for Crime and Justice Policy. Morgan’s story started in 2012, after she was arrested and incarcerated on charges of burglary and robbery. Initially placed on suicide watch, a 2013 competency evaluation determined Morgan was a suicide risk. She was first housed at the Florence McClure Women’s Correctional Center in North Las Vegas, then transferred to Jean Conservation Camp. There, she walked off the premises with another inmate in 2018. Correctional center officials sought help from Morgan’s mother to locate and reincarcerate her. With Lackey’s help, Morgan was found more than a week later and was sent back to the Florence McClure Women’s Correctional Center. Lackey said she told a corrections officer there that Morgan should be put on suicide watch again or placed in a psychiatric ward for her own safety. But within 48 hours of her return to Florence McClure, Morgan was found dead in her cell, without suicide watch or psychiatric care. “I sought out legal action because I wanted some type of justice for my sister,” Lopez said in an interview with The Nevada Independent. Lopez and Lackey claim that prison officials violated the Eighth Amendment (which prohibits cruel and unusual punishment) by ignoring her risk of suicide. The suit says Lackey’s loss of her daughter also violated the Fourteenth Amendment (which prevents any person’s life, liberty, or property from being deprived without due process). Lopez and Lackey called state corrections officers “deliberately indifferent” in the lawsuit and alleged multiple instances of improper medical care and negligence. An affidavit from Kimberly M. Pearson, a medical expert, says Morgan was readmitted without a medical evaluation and was housed with potentially dangerous objects without regard to possible suicidal ideation. When nurses in the facility found her, they made poor attempts to resuscitate Morgan with CPR or an automated external defibrillator, Pearson said. “There was no appropriate positioning and opening of the airway nor the administration of breaths as required by Basic Life Support algorithms until approximately six minutes into the resuscitative process,” Pearson said in the affidavit. The Nevada Department of Corrections did not respond to multiple requests for comment. But in court filings, the department argues that Lopez and Lackey do not have grounds to sue for an Eighth Amendment violation because neither of them was incarcerated. Additionally, they claim that one of the officers named in the case was not present for work on the day of Morgan’s suicide and could not be held liable for any charges. The named corrections officers have in turn accused each other of miscommunication in response to the lawsuit. One officer — who contacted Lackey for help relocating Morgan after her escape — called another officer, relaying Lackey’s concerns about Morgan’s health. That second officer claimed to have informed a third officer of the issue, but the third individual denied being notified in the first place about Morgan’s health. Court documents also said two facility nurses admitted that they had not read the “receiving screening” medical directive, corrections department policy which requires nursing staff to assess inmates for medical needs upon arrival to a correctional facility. The case is now in federal court for a settlement conference, where the opposing parties will try to reach a mutually agreeable resolution in the case. An ongoing discovery process could potentially make it in front of a judge in the next year. After that, Robinson climbed up a fence and scaled the wall, where he lost his balance and toppled over, Benton said. But 11th Circuit Judge Andrew Brasher, who wrote the opinion, cited “substantial evidence” to the contrary. One eyewitness testified that she heard a “pop” when Robinson was on top of the wall, Brasher noted. Yet another said he saw Robinson “stiffen up (like) he went into shock” before falling off the wall. Also, part of a cartridge from Benton’s Taser was found on the other side of the wall from where Benton said he’d been standing. This suggests the Taser had been fired upwards and over the wall, Brasher said. If this is what happened, Brasher wrote, “We have little trouble in concluding this use of force was excessive. … Tasing a person who is at an elevated height may come with a substantial risk of serious bodily harm or death.” Brasher noted there was nothing in the record of the case that showed Robinson was dangerous or posed a threat. A team of doctors and lawyers have been charged in a five-year slip-and-fall scam that brought in over $31 million. New York City authorities discovered that over 400 people were recruited in the scheme to claim that they’ve tripped and fallen on faulty sidewalks. The participants would then file lawsuits with specific lawyers, seeking damages in the millions for the alleged falls. Those lawyers would then refer them to particular doctors to receive medical care to back up their claims. Key players in the scheme who have been charged include New York-licensed attorneys George Constantine and Marc Elefant, who filed the fake lawsuits on behalf of hundreds of fraudulent patients. New York-licensed orthopedic surgeon Andrew Dowd performed hundreds of unnecessary shoulder and knee surgeries on participants, earning nearly $9,500 per procedure. Pain management doctor and surgeon Sady Ribeiro, also licensed in New York, conducted back operations on almost 200 participants. He paid the “patients” cash kickbacks in exchange for referrals. Patients who underwent the unnecessary received up to $1,500 in some cases. While the money paid to participants was minimal for undergoing such serious surgeries, U.S. Attorney Audrey Strauss said that the doctors and lawyers targeted poor people in the fraud, some of which only requested food during their initial meetings with the ringleaders. “Many of the patients did not have sufficient clothing to keep them warm during the wintertime and had poor-quality shoes. Members of the fraud scheme also recruited patients who were drug addicts. It was also common for scheme participants to recruit patients from homeless shelters in New York City,” Strauss stated. The four men face a slew of charges, including mail and wire fraud. They could serve 20 years in prison if convicted. (KMIZ) The family of a Jefferson City man filed a COVID-19 wrongful death lawsuit Friday against a Jefferson City nursing home one day before a law shielding businesses from such suits takes effect. David Ousley died Oct. 4 at age 83 after contracting COVID-19 while living at Jefferson City Manor, his family says in the lawsuit filed in Cole County. Ousley is one of 13 residents of Jefferson City Manor who have died during the pandemic, according to federal data. The family is suing the nursing home and its owner, Juckette Management Services Senior Living, Inc. The lawsuit alleges Ousley became infected with coronavirus while the nursing home was under quarantine in August 2020 and no residents had previously been infected. Ousley’s family says he caught the virus from an infected employee. Ousley’s family accuses the nursing home of not taking proper steps to screen employees for COVID-19, which led to David Ousley’s death. A new state law that shields businesses from lawsuits except for cases of “reckless or willful misconduct” takes effect Saturday. It’s not clear how that law will affect the Ousley suit. The Ousley family’s lawyer was not available for comment Friday and Juckette has not responded to a request for comment.
